The phrase, “You cannot be prosecuted in criminal court to collect this loan” must be on the agreement in a size that is at least 14 bold face type. Additionally, any business which provides a cash advance in New Mexico must stamp the borrower’s check with the phrase, “This check is being negotiated as part of a loan pursuant to the Payday Loan Act, and any holder of this check takes it subject to all claims and defenses of the maker.”

There is a maximum payday loan term of 35 days. A payment plan for those who cannot meet this requirement can be instituted, however, allowing a repayment period not to exceed 130 days. Maximum loan amounts cannot exceed 25% of a borrower’s gross monthly income. Finance fees of $15.50 can be charged for each $100 borrowed.
