Samsung Attempts to Block Sale of New iPhones in Europe

Lawsuits to Be Filed in Italy and France Cite Patent Infringement and Continue Ongoing Patent Battle Between Two Companies

On October 4th, Apple announced the launch of its iPhone 4S, the newest iteration of its iPhone line. While pre-orders will be allowed later in the same week, consumers in Italy and France may have to wait a bit longer to get their Apple fix. That is, if a set of lawsuits Samsung has announced against its competitor are deemed true.
Since Samsung announced the release of its iPad competitor, the Galaxy, Apple has filed lawsuits across the globe citing patent infringement. The company has been successful in some instances in keeping the Galaxy tablet computers off store shelves. In fact, Samsung recently announced the removal of some features in its product in order to abate the legal delays and get its product to market.
Other patent infringement cases against some Samsung smartphones have left the Korean tech giant unable to sell its wares in 30 European countries.
Now it is Samsung’s turn to play the injured party. As posted on the company’s official blog, “Samsung’s preliminary injunction requests in France and Italy will each cite two patent infringements related to wireless telecommunications technology, specifically Wideband Code Division Multiple Access (WCDMA) standards for 3G mobile handsets.”
This news does not come as much of a surprise to those in the tech industry, however, as Samsung had previously announced plans to file lawsuits against the next iPhone model. While many Apple fans were disappointed by the announcement of a new type of iPhone 4 instead of the much-predicted iPhone 5, the phone was nonetheless targeted by Samsung immediately.
Once again from the Samsung blog, the company wrote, “The infringed technology is essential to the reliable functioning of telecom networks and devices and Samsung believes that Apple’s violation as being too severe and that the iPhone 4S should be barred from sales.”
In the tech industry, the shelf life of new products can be extremely short. Delaying a product for even six months can more or less destroy its commercial viability once it finally is put up for sale. Such is the current situation with the Samsung Galaxy in Australia.
Samsung has not gone through the legal proceedings without accumulating its fair share of bitterness. The company ended its blog post by saying, “Apple has continued to flagrantly violate our intellectual property rights and free ride on our technology. We believe it is now necessary to take legal action to protect our innovation.
Whether that feeling is merited remains up to the courts in Europe, and most likely other continents in the future, to decide.
